*Terms & Conditions of Sale (Agreement)SUPPLY OF SYSTEMSubject to the remainder of these terms, upon purchase through our online store, GeraldtonSolar.com.au, SUN CITY SOLAR agrees to supply & install the System at the premises within 6 weeks of approval from all required applications and departments, subject to availability in consideration of You (the customer):(a) upon placement of order on our online store, your payment is processed and released to SUN CITY SOLAR;(b) We will contact you (the customer) and confirm the purchase within 7 days.(c) We will prepare the documents required and control their application, so we get responses as soon as possible from Synergy and Western Power. This insures speedy installation.NOTE Synergy application takes seven days minimum for their reply, and Western Power can take six to eight weeks. We advise full approval process is eight weeks.(d) You agree to assigning to SUN CITY SOLAR all your right to receive any Energy Trading Certificates arising from installation of the System including (without limitation) Renewable Energy Certificates ["RECs" or STC credits] under the Renewable Energy (Electricity) Act 2000.2. SUITABLE SITE Please check our site suitability page on this web site prior to ordering any system.(a) this agreement is subject to SUN CITY SOLAR technicians being satisfied that the premises are suitable for installation of the system. Many factors (such as age, shape, orientation, accessibility & shading of roof) may influence suitability. If SUN CITY SOLAR is not satisfied we will offer alternative designs, and in this case, we will out of good faith, amend the purchase, to a suitable system, if you (the customer) have followed the guidelines outlined on our online store.(b) If, upon technician's inspection of the premises, physical installation of the System presents us with complexities or difficulties, SUN CITY SOLAR may determine that additional installation charges are applicable: in this case you (the customer) agree to accept these additional cost, as outline on the guidelines outlined on our online store. (c) You warrant that you will allow access & facilitate SUN CITY SOLAR (via its contractors, employees or agents) to visit the Premises during reasonable business hours to inspect premises and to supply & install the System, and that you have the right to do so.(d) After the statutory cooling off period, SUN CITY SOLAR reserves the right to retain up to $450.00 of your deposit to cover costs of service if an application is withdrawn by you after signing of this agreement and the site is deemed suitable for the solar installation.(e) You warrant that, if the system is a solar photovoltaic system, it will be the first small generation unit (connected to the electricity grid) installed on the Premises and that you have not entered any other agreement to fund it.3. AVAILABILITY AND SUPPLY OF SYSTEMIf the System offered becomes unavailable; SUN CITY SOLAR reserves its right to substitute the offered System with an equivalent product.4. INSTALLATION (a) SUN CITY SOLAR will give at least 1 weeks' notice of the installation date. On that date, it will install the System, ensure it is operational and (if it is a solar photovoltaic system) then you will assist us to promptly lodge all necessary paperwork to recover the rebate discount amount, under the solar credits scheme- Renewable Energy Certificates, creation.(b) Absent intervention by force majeure (including, without limitation, acts of God and interruptions to supply beyond SUN CITY SOLAR'S control), SUN CITY SOLAR will complete installation within 12 weeks of approval from all regulatory departments.5. METER INSTALLATION, POWER GRID CONNECTION & FEED-IN TARIFFS (a) SUN CITY SOLAR will assist in arranging for the system to be connected to the grid and for installation of the meter at the Premises; you (the customer) agree to provide all necessary applications, filled out correctly as per the guidelines outlined on our online store.NOTE: the costs and risks of that connection and meter installation are not included in this agreement and is an agreement with you power provider.(b) You agree that the works described in clause 5(a) would be by agreement between you and your electricity retailer.(c) You agree that SUN CITY SOLAR has provided no guarantee that you will be accepted into any State feed in-tariff scheme or that you will receive any feed-in tariffs or compensation for excess flow of electricity to the grid.6. SUN CITY SOLAR reserves its right to adjust the final 'balance to pay' upwards if, on the day of installation, the value and/or quantity of the RECs is devalued by Government interference or by market forces see Solar Credits/STCs (formerly known as RECs) rebate payment section bellow
7. PRIVACY (a) you agree to supply SUN CITY SOLAR with any information necessary to complete documents required for connection of the System (if it is a solar photovoltaic system) to the electricity grid and to claim you’re rebate entitlements (RECs).As per the Solar Credit Scheme.(b) You authorize SUN CITY SOLAR to share this information (to the extent that is necessary) with its contractors, employees & installers and with relevant government agencies, RECs agency’s & electricity retailers.(c) SUN CITY SOLAR will not release your personal information to any other parties without your written consent.8. ASSIGNMENT (a) you cannot assign the benefit of this agreement or any rights or obligations hereunder (whether in whole or part) without the prior written consent of SUN CITY SOLAR.(b) SUN CITY SOLAR may assign its benefit (RECs) & obligations hereunder without Your consent upon notice in writing to you but must guarantee performance by the assignee to no lesser standard than that required herein.9. LIABILITY AND RISK (a) SUN CITY SOLAR shall not be liable for any loss or damage caused by late installation of the System. Your only remedy for such lateness is termination of the contract and refund minus any amounts recoverable by us for out of pocket expenses.(b) Insurance risk in the system passes to you upon delivery of the system components to the installation address.(c) SUN CITY SOLAR warrants its workmanship in installing the System for 24 months from installation, but any interference, modification or tampering with the installation voids that warranty.(d) You accept the manufacturer's warranty over goods comprising the System.(e) SUN CITY SOLAR does not warrant your entitlements to RECs or that the System will perform at any specific level: performance is affected by many external factors (e.g. sunlight hours, cloud cover, weather patterns, orientation of panels, and shading by flora or other buildings).(f) Except as agreed herein or required by law, all express and implied warranties are excluded and SUN CITY SOLAR shall not be liable for any physical injury, financial loss or damage (whether direct or consequential) arising from the supply & installation of the System.(g) SUN CITY SOLAR'S liability for a breach of a condition or warranty implied by DIY 2 of Pt V of the Trade Practices Act 1974 (Cth) (other than s.69) is limited to repair or replacement of the System components or the supply of an equivalent System, or to supplying installation services again.10. TERMINATION (a) you may terminate this contract prior to the date set for installation of the System, but will forfeit the all or part of your payment to cover any cost.(b) Either party may terminate this agreement prior to installation if the other party breaches a warranty (or threatens to do so) and does not rectify within 7 days of written notice, or is insolvent or enters any scheme, composition or arrangement with any of its creditors: inthese events the deposit is refundable.(c) If the government subsidies or discounts detailed overleaf are withdrawn or changed, SUN CITY SOLAR may terminate this contract unless you agree to pay any new difference arising.11. FAILURE TO PAY (a) If You fail to pay the full system amount, the agreement will not be binding until the amount is received by SUN CITY SOLAR.(b) If you fail to pay the balance owing on or before the installation date, then you consent to SUN CITY SOLAR having a caveat able interest in the said property and registering a caveat against the title to the said property. Such caveat to remain in effect until payment in full is made.12.DO NOT CALL REGISTERBy providing your telephone number; you warrant that you are the relevant telephone account holder (or their nominee) within the meaning of the Do Not Call Register Act 2006 (Cth). You hereby consent to being contacted by telephone in relation to SUN CITY SOLAR goods and services, such consent to continue indefinitely.13.ENTIRE AGREEMENTThis agreement is governed by the laws of Western Australia and the parties agree to submit to the jurisdiction of the courts & tribunals of that State. It constitutes the entire agreement between the parties and replaces all prior agreements, verbal or written. It cannot be varied except in writing. Any invalidity in this agreement shall be severed and the remainder saved. Any words importing number or gender encompass all numbers & genders. Notices under this agreement can be posted by registered mail, or faxed or emailed, to the other party at the contact details shown in the quote.14. DEFINITIONSWords used in this agreement, including 'Premises', 'System' and 'You', bear the meanings described on the quote overleaf.

You will receive an official tax invoice within seven days from Sun City Solar, which will outline rebate discount amount formally. The cost of the system online is a discounted system for online purchases. This online payment is for securing stock and processing your order. If there is an amount or balance of payment that is required, for alteration to supply your system this will be due on or before the installation date of the solar panels and inverter. Work to be completed by third parties (including but not limited to the meter installer and/or Energy Company) is not grounds for withholding or delaying the installation.Payments are to be made by MasterCard or Visa or your PayPal account via the online PayPal payment provider.A “cooling off period” is only applicable to this contract in some circumstances where State, Territory or Federal laws require it.Solar Credits/STCs (formerly known as RECs) rebateYou agree to assign the Solar Credits or STCs (Renewable Energy Certificates) (formerly known as RECs) earned by the above system to Sun City Solar as part of this agreement and above discounted price by way of a point of sale discount. You agree to sign all documentation necessary for Sun City Solar to claim the STCs or Solar Credits on your behalf. The net system price payable by you (the customer) is calculated on your eligibility for the discounts set out in the order form (i.e. STCs or Solar Credits). You understand that if you are not eligible for these discounts for any reason or if laws governing the STCs or Solar Credits Scheme change in any way the amount payable by me the customer may change.Grid Connection, Meter installation and Solar Buy BackThis agreement DOES NOT include the cost to purchase and install the new meter, which will be charged to you by a private meter contractor (or your energy retailer in some states) following installation of the solar system. The cost of a meter installation is typically $150-$400 but can cost more in some cases. Contact your service provider for full price of meter replacement. You understand that although Sun City Solar may assist in arranging connection to the main grid and meter installation the agreement to undertake this connection is between you and your energy retailer and/or distributor.You understand that different energy retailers and/or distributors have different rules, requirements and rates regarding what they will pay you for the solar electricity you generate and export. Sun City Solar accepts no responsibility if the customer does not receive the renewable energy buy back or any feed-in tariff. Please check with your retailer as to whether they provide the solar buy-back in your area and for any special related conditions. Feed in tariffs or solar electricity buy back schemes are governed by State and Territory laws and Sun City Solar accepts no responsibility if these laws change in any way affecting the system’s return on investment.
Additional costs:From time to time, Sun City Solar encounters sub-standard, broken, or illegal electrical installations, they can be from previous owners or works.Any electrical work required to bring your building’s wiring or switchboard up to code (AS3000) is not part of this agreement and will be payable by the customer.We will endeavour to consult you of these works prior to conducting any works that may be billable to you.As we are a licensed electrical contractor we must sign statutory declaration that your premises are electrically safe, and we have inspected your electrical systems. We are required to sign notices and electrical safety certificate’s and we are required to disconnect or repair any unsafe electrical work. We will always endeavour to contact you if such arises. Copies of these documents will be included in your manuals, plus any recommendations of areas that require attention.
System PerformanceAny performance and return on investment figures indicated by Sun City Solar are given in good faith but are estimates only. These figures are based on average weather patterns for your nearest capital city. System performance will vary from site to site based on several reasons, which include but are not limited to orientation and pitch, shading of the system and varying local weather patterns.Availability of GoodsDue to the volatility of the solar panel market Sun City Solar reserves the right to provide different panels and/or inverters than those specified in this order form. The nearest equivalent panels and/or inverter will be supplied. While we try to adhere to delivery and installation dates wherever possible delays in installation are not grounds for cancelation and Sun City Solar is not liable to you to “make good” any perceived loss because of these delays.Responsibility & OwnershipGoods delivered to site become the responsibility of the customer from the moment of delivery. This responsibility extends to damage and theft as well as any liability arising in relation to the goods. Ownership of the goods passes to the customer when any amount outstanding has been paid in full including any rebate amountInstallationSUN CITY SOLAR offers a minimum 2-year workmanship warranty (24 months) (NB this does not cover the panels and Inverters themselves which have their own warranties indicated below).Inverter locationThe site selected for the Inverter, will be by our service technicians after any consultation by you (the customer). Consultation of the site selection for Inverter and panel installation MUST be received within seven days of order, to give us reasonable time to evaluate the site.
WarrantyThe warranties for the solar panels, Inverters and racking are held by the manufacturers or importers. The solar panels carry a 25-year output warranty and minimum 5-year product warranty the Inverters carry a minimum 5-year product warranty and the solar panel racking carries a 10-year product warranty. Please refer to the warranty documents in your manual, or by checking details on our web site for each individual product for specific details. Sun City Solar will assist the customer according to the manufacturer’s/importer’s warranty terms to repair or replace any parts found to be faulty.If parts are not found to be faulty a $180 call out fee may be charged.You accept the above contract & conditions.The company reserves the right to accept or reject this contract. Company Signage Requirement. Following completion of installation, there is a requirement for a company sign to be place on or near your front boundary, advertising this house is now powered by solar. The sign remains the property of Sun City Solar, and to remain for a period of not less than 12 months from completion, after that period the sign can be removed and returned to Sun City Solar, or request for us to remove it at our convenience. *Terms and Conditiona updated from time to time, please check on your written contract to confirm.
